E-Sign & Electronic Communications Notice

1. Consent Statement

1.1. Applicability of Consent:
- You are applying for a Finup Card. If you consent to this Consent Statement for this Program, it applies even if you do not obtain (or are not offered) a Finup Card.

1.2. Scope of Consent:
- Your affirmative consent to this E-sign & Electronic Communications Notice (“Consent”) allows:
- Finup and its partners to provide you with such Communications electronically
- Electronic signing and authorization of Communications through the Dashboard or API ("Dashboard", "Platform", or “Service”)
- Collection of such e-signings by Finup and its partners

- If you do not consent to electronic delivery of Communications, you will not be able to use the Service.

By registering for a Finup Account, applying for a card, or accessing the Finup Dashboard, you:
- Agree that such registration constitutes your electronic signature
- Consent to us providing notices to you, your Company Administrators, and Company Users (including those required by law)
- Agree to ensure that all Company Administrators and Company Users also consent to receiving User Notifications electronically
- Understand that this consent has the same legal effect as a physical signature

1.3. Paper Delivery Option:
- You have the right to receive legal disclosures, notices, and communications (collectively, the "Covered Items") in paper form by mail.

We may instead provide these items electronically if you:
- Give us your Consent
- Meet the System Requirements listed below

For purposes of this Consent Statement, Covered Items include:
- All servicing and collection communications on your account
- All legal disclosures, notices, and communications that Finup is required to provide in writing regarding the account

In this Consent Statement, “we,” “us,” and “our” refer to: Finup and our service providers.

2. Duration of Consent

2.1. Term of Effectiveness:
- Your Consent remains effective until either (a) you or we have terminated the Program or your Card, or (b) you opt out of electronic communications.

2.2. Post-Termination Validity:
- If you terminate your Card, your Consent will still continue for Finup’s pre-termination rights (including those created by this Consent Statement). Refer to your cardholder agreement for more details.

3. Methods of Providing Covered Items

3.1. Delivery Channels:
- In this Notice, "provide" includes: deliver, make available, send, notify, or any similar term.
- Covered Items may be delivered electronically through email, the Dashboard, or through downloadable files on our website.

3.2. Responsibility for Review:
- It is your responsibility to promptly review the Covered Items so that you may take appropriate action.

4. Access to Paper Copies

4.1. Requesting Paper Versions:
- You may request a paper copy of any Covered Item at no cost by contacting us at hi@finup.io.

4.2. Record Retention:
- We retain copies of Covered Items only for the periods required by law. We will provide them upon request within those periods.
- To ensure continued access, we recommend that you download or print any Covered Items upon receipt.

5. Our Right to Provide Paper Copies

5.1. Discretionary Paper Delivery:
- Finup reserves the right to provide Covered Items in paper form at any time at our discretion, even if you have previously given electronic Consent.

5.2. Examples:
- Examples of when this may occur include system outages, suspected fraud, or legal requirements.

6. Hardware and Software Requirements

6.1. System Access:
- To access and retain Covered Items electronically, you must have a device with working Internet access and a web browser that supports 128-bit encryption (we support the latest versions of Chrome®, Firefox®, Microsoft Edge®, or Safari®).

6.2. Viewing Tools:
- You must also have at least 16 MB of available memory (32 MB RAM recommended) and a program to view, save, and print PDF files (e.g., Adobe® Reader® version 4.0 or higher). You can download Adobe® Reader® from get.adobe.com.

6.3. Acknowledgement:
- By giving Consent, you confirm that you meet these system requirements.

7. Withdrawing Your Consent

7.1. Withdrawal Rights:
- You may withdraw your Consent at any time, free of charge.
- However, if you do so before your application is approved, you may not be able to receive services from us online.

7.2. How to Withdraw:
- To withdraw your Consent, email us at hi@finup.io.

7.3. Legal Validity:
- Withdrawing Consent does not affect the legal validity or enforceability of any prior electronic Disclosures.

8. Confirmation of Access and Agreement

8.1. User Confirmation:
- By confirming that you have read and agreed to this Notice, you acknowledge that:
- You have access to a computer system that meets the requirements listed above
- You agree to receive Covered Items electronically
- You are able to access and print or store the information presented to you
